Main objectives and functions of the State Customs Committee of the Republic of Belarus are defined by Presidential Decree of April 21, 2008 № 228 "About some issues of customs authorities"
Main objectives of the SCC
- to pursue the state customs policy, to implement the regulation and control in customs matters and coordination in this area the activity of other central government bodies and other organizations;
- to ensure, within its competence, economic security of the Republic of Belarus, to protect economic interest;
- to develop and apply means of customs regulation for development of the trade and economic relations of the Republic of Belarus;
- to organize and improve customs control and customs clearance, create conditions accelerated trade turnover through the customs border of the Republic of Belarus, the development of foreign economic activities of organizations and individuals, to ensure the implementation of these measures;
- to prevent and suppress smuggling and other crimes, administrative violations in the customs;
- to ensure compliance with international obligations of the Republic of Belarus relating to customs.
Functions of the SCC
SCC in accordance with its mandated tasks:
- to develop and make proposals on the improvement of state customs policy to the President of the Republic of Belarus in due course;
- to inform the President of the Republic of Belarus, the Council of Ministers of the Republic of Belarus and the State Secretariat of the Security Council of the Republic of Belarus about threats to economic security of the Republic of Belarus;
- to design and implement the program for the development of customs business in the Republic of Belarus approved by the President of the Republic of Belarus and the Council of Ministers of the Republic of Belarus;
- to participate in the development of normative legal acts that determine the legal, economic and organizational mechanisms for implementing the state customs policy;
- to participate in the development of economic measures with regard to the goods transported through the customs border of the Republic of Belarus;
- to participate, within its competence, normative legal acts in the field of customs;
- to create, reorganize and eliminate customs, as well as the organizations, subordinate to the State Customs Committee in agreement with the President of the Republic of Belarus;
- to govern customs and organizations subordinate to the State Customs Committee;
- to organize customs collection of customs payment, control over the correctness of their calculation, timeliness and completeness of payment, to apply measures on enforced recovery of customs payments to the budget;
- to organize a system of control over the correctness of determining the customs value and the origin of good;
- to contribute the proposals on improvement of tariff and non-tariff regulation of foreign economic activity in due course;
- to keep the Commodity Nomenclature of Foreign Trade, to give explanations on its application;
- to keep the register of customs agents (representatives), customs carriers, warehouses of temporary storage and customs warehouses, intellectual property, banking and non-banking financial and credit institutions, recognized by the customs bodies as guarantors of customs payments, persons who have the status of "honest participant of foreign trade activities”;
- to determine the cases of submission to the customs authorities documents proving the metrological and other characteristics of the goods, as well as documents confirming their loading into vehicles in order to reduce the time of customs clearance of export goods;
- to ensure the procedure of movement of goods and vehicles across the border of the Republic of Belarus;
- to establish customs clearance points for customs clearance of certain types of goods (excluding the items of import and export in the cases established by the Customs Code of the Republic of Belarus);
- to determine the procedure of the statistical declaration in respect of transported goods;
- to determine the forms of documents required for customs purposes, including forms of documents relating to the operations of customs control, customs regimes, customs procedures, procedure and execution period of their submission to the customs authorities, as well as the procedure for their use;
- to determine the procedure of completion of the customs processes in accordance with the Customs Code of the Republic of Belarus;
- to determine the procedure of formation, presentation and use of documents in electronic form for customs purposes;
- to put a time limit for the submission of documents and information required for customs clearance, in accordance with the Customs Code of the Republic of Belarus;
- to determine the features of means of identification of goods and documents on them;
- to regulate issues about confirmation of the actual export of the goods;
- to establish the order for customs clearance of goods sent by international mail, in cases determined by the Customs Code of the Republic of Belarus;
- to decide on the exclusion from customs procedure of customs transit a carrier, who has not repeatedly fulfilled the duties to transport goods in accordance with customs procedure of customs transit in the cases determined by the Customs Code of the Republic of Belarus;
- to prolong the terms of customs control operations in cases determined by the Customs Code of the Republic of Belarus;
- to determine the lists of customs officials authorized to make the decision about conducting of customs inspection, customs officials, who have the right to conduct customs inspection of premises and territories, and also to maintain the form of the regulations and the inspection report;
- to organize the collection and processing of information about the movement of goods and vehicles across the customs border and customs clearance, to design methodology and organize maintenance of customs statistics of foreign trade and special customs statistics;
- to provide the data of the customs statistics of foreign trade of the Republic of Belarus to the President of the Republic of Belarus, the National Assembly of the Republic of Belarus (to the House of Representatives and the Council of the Republic), the Council of Ministers, other state bodies determined by law, to international organizations, in accordance with the legislation, including international treaties of the Republic Belarus, to publish the data of customs statistics of foreign trade of the Republic of Belarus in printed periodicals of the SCC;
- to determine the order and form of accounting the goods which are under customs control and reporting forms which are submitted regarding such goods;
-to enter into agreements with other state bodies on the organization of cooperation in the fight against crime, within its competence, to cooperate with other state bodies and other organizations on these issues;
- to provide assistance to the competent authorities of the Republic of Belarus in combating international terrorism, organized crime and in suppression of illegal interference at the airports of the Republic of Belarus in the international civil aviation;
- to organize the work on prevention, detection and suppression of offenses committed by customs officials, employees of organizations subordinated to the State Customs Committee, to provide the solution of these problems in cooperation with other law enforcement agencies;
- to carry out, within its competence, the operational search activities, inquiry, proceedings on administrative offenses, and to prosecute people to account for committing administrative offenses in accordance with established order;
- to organize, within its competence, conducting customs checks by the customs authorities, according to the methodology of customs inspections and the form of customs inspection report;
- to conclude, within its competence, in accordance with established order international treaties of the interdepartmental character with the relevant government authorities of foreign countries and (or) international organizations involved in the conclusion of other international agreements and cooperate with customs and other competent authorities of foreign states, international organizations in customs matters, and to ensure the fulfillment of international duties of the Republic of Belarus regarding the customs;
- to ensure uniform application customs and other legislation by the customs bodies and organizations subordinate to the State Customs Committee;
- to organizes, within its competence, exchange controls, to monitor customs work in the exercise of exchange control;
- to determine the order for the use of preliminary information about goods transported across the customs border;
- to organize and improve the functioning of the risk of management system, to determine the method of risk management;
- to participate in the organization of export controls, controls over the export of strategic materials, as well as cultural values;
- to provide, within its competence, protection of intellectual property rights;
- to request and receive relevant information in accordance with the established order from other state organs of other governance and other state organizations, subordinate to the Council of Ministers of the Republic of Belarus , from local executive and administrative bodies, and from other organizations and natural persons;
- to produce the issuance of special permits (licenses) for carrying out activities in the field of customs, their duplicates, amendments and (or) additions to the special permit (license), suspension, resumption, extension of special permits (licenses), the cessation of their activities, control for realization activities in the field of customs affairs by licensees, to determine the order for the issuance and revocation of qualification certificate of a customs clearance specialist;
- to arrange counseling and informing of stakeholders on customs regulations and other issues, within the competence of the customs authorities;
- to examine citizens' requests, within its competence in accordance with established order, including independent entrepreneurs and legal entities;
- to ensure formation, optimization and development of customs infrastructure, within its competence, to cooperate on these issues with other state bodies and other organizations;
- to develop the material and technical basis of customs and institutions subordinate to the State Customs Committee, in due course, to perform the functions of the state customer for goods (works, services), to organize and finance the customs and institutions subordinate to the State Customs Committee, within the limits of budgetary appropriations and other sources, identified by the legislation;
- to design logistics policy and rules of customs authorities and organizations subordinate to the State Customs Committee, to submit them in accordance with established procedure for approval by the President of the Republic of Belarus, to ensure accounting, storage and consumption of material and financial resources in accordance with approved order and standards;
- to dispose property assigned to the customs authorities and organizations subordinate to the State Customs Committee in due course;
- to organize and (or) participate in scientific research and development activities in order to methodological and scientific-technical development of the customs authorities and organizations subordinate to the State Customs Committee;
- to determine the technical policy in terms of development, equipping and introduction into the customs authorities the technical means of customs control, radiation detection devices, means of telecommunication and communication;
- to develop, produce and use the information systems and information technology in the customs authorities, to determine the order of formation and use of information resources of customs bodies;
- to organize accounting and reporting in customs and institutions subordinate to the State Customs Committee;
- to organize recruitment, training, retraining and advanced training of customs officials of customs authorities , corporate employee subordinate to the SCC, to conduct, within its competence, the state personnel policy in customs authorities and organizations subordinate to the State Customs Committee, to form the management personnel and its reserve;
- to organize the ideological and educational work in the customs authorities;
- to provide legal and social protection of customs officials, organizations subordinate to the State Customs Committee, retirees from the number of customs officials as well as members of their families;
- to establish manner periodicals in due course;
- to organize and conduct, within its competence, acquisition, registration, storage and use of archival documents.
